Home Information Packs ˆ HIPS ˆ have revolutionised the house selling process. You cannot now advertise your property for sale with or without an estate agent until your advisers have prepared a HIP for your property. If you do try to sell your property without a HIP you will be liable to pay a fine of up to £200 for each day that you fail to comply with this law. Consequently, it is the responsibility of your estate agent to prepare your HIP before trying to sell your property.
Your HIP will by law have to include evidence of your legal title to your property, replies to what are presently known as replies to preliminary enquiries and at the very least a local authority search of your property with details of any adverse entries. All these mandatory requirements can in our view only be properly prepared by your lawyer. An estate agent working without a lawyer cannot do this. If the HIP contains inaccurate or misleading information then again you may be breaking the law.
